A 15-year-old youth appeared before Selby magistrates charged with breaching the conditions of his bail by having a cigarette lighter.
The youth, who cannot be identified for legal reasons, was caught after having a crafty smoke with schoolmates.
The court heard that the youth is on bail to appear before Sheffield Crown Court later this year on a charge of arson with intent to endanger life.
One of his six bail conditions - including living in the Selby area until the crown court hearing - on the charge is that he should not be in possession of anything which can be used in connection with an offence of arson.
The court heard that the boy has been on bail for over a year and that this had been his first breach of the conditions.
Keith Haggerty, defending, said that smoking outside school amongst schoolchildren was “endemic” and that it would be a “responsible” view of the breach to do no more than re-bail his client.
Magistrate Hillary Gilbertson said that she and her two colleagues regarded the breach as a “blip” and agreed that the youth should be re-bailed on the same conditions.
